Drafting of Wills

We provide Will drafting services to ensure that your intentions and wishes are properly recorded in a Will to ensure the protection of both your estate and beneficiaries.

Our services also entail that you are advised regarding whether you require one worldwide Will to deal with your assets or whether you require a foreign Will to deal with assets in a particular jurisdiction. You may require a foreign Will depending on several factors which include: how many jurisdictions your assets are situated across, the laws of the jurisdiction(s) in which your assets are situated and the size and nature of your assets in a particular foreign jurisdiction.

Leaving behind a clear and valid Will is also kind to your loved ones, by making the division and winding up of your deceased estate just a little bit simpler.

With so many challenges to deal with, it is understandable that worrying about what happens to our assets after we die is not one of our primary concerns. However, the avoidance of this topic can cause serious problems for your loved ones upon your passing. When you draft a Will, you are ensuring that those you love are looked after according to your wishes and that your assets are distributed in an efficient manner.

Fee Schedule for Wills and Living Wills

Single Local South African Will This can include offshore assets and includes taking instructions from client, drafting the Will and one round of amending it, and storage of the signed Will in a fireproof Will safe. R2 000
Single International Will This includes taking instructions from client, drafting the Will and one round of amending it , and storage of the signed Will in a fireproof Will safe. R2 000
Mirror Will for a Spouse/Partner This includes taking instructions from the client’s spouse/partner at the same time as client, drafting the Will and one round of amending it, and storage of the signed Will in a fireproof Will safe. A ‘mirror’ Will is a second identical Will for the client’s spouse/partner. R1 000
Single Living Will This includes taking instructions from client, drafting the Living Will and one round of amending it, and storage of the signed Will in a fireproof Will safe (a copy of which should also be filed with client’s physician). R650
Amending the Executor in Existing Will This includes drafting a codicil to amend the Executor in an existing Will, and storage of the signed Codicil in a fireproof Will safe. R1 000
Review of an existing Will This includes a review of an existing Will to confirm if it is sufficient or whether it needs to be updated. (If this review is of our Will, done a year or more later, and the required amendments are significant, we reserve the right to charge for a new Will). R900
Review of an existing Living Will This includes a review of an existing Living Will to confirm if it is sufficient or whether it needs to be updated. R300
Additional Amendments / Advice on Will Additional amendments / advice on a Will will be charged per round of amendments / email questions on the Will (for us to consider and respond / effect the amendments). R400
Additional Consultations Additional consultations, if the client requires them, will be charged on a time spent basis. R2 000
per hour

(Note: we can only draft international Wills for some foreign countries and will advise clients accordingly. Where we cannot draft the required Will we will refer the client to our overseas colleagues to assist. Any charges incurred by our overseas colleagues are not included in these costs).

The above fees are exclusive of Value Added Tax and are valid until 28 February 2021.

 

Executor’s Fees

If our chosen service providers are recorded in the Will as the Executor, we offer executor’s fees at a discounted fixed rate of 2% (plus V.A.T.) on the gross value of the worldwide assets in an estate, as opposed to the tariff rate of 3.5% plus V.A.T., subject to a minimum fee of R15 000.00 plus V.A.T.

  • Our above stated minimum fee is subject to change from time to time.
  • To the extent that a correspondent attorney in a foreign jurisdiction is required to assist with the winding up of client’s estate, such expense will be in addition to the executor’s fee.
    The Executor will obtain approval from the heirs of the estate prior to incurring any additional expenses.
